Legal studies
Reprobel itself regularly has research bureaus carry out studies on specific aspects of copying. These are targeted, small-scale studies designed to obtain better insight into the trends concerning copying protected works. The collaboration of persons, companies, institutions or organisations in these studies is always voluntary.
In addition, Reprobel is required by law to carry out a large-scale study every five years in order to gather statistical data on copying.
The legal basis of this obligation is a Royal Decree, more specifically article 26 of the Royal Decree of 30th October 1997. Click here for the complete text in pdf-format. The study is intended to generate objective data that Reprobel and the operator levy payers can use as a basis for estimating the number of copies of protected works. Since the study also concerns the distribution of the number of copies across different categories of protected works, it contributes to a more accurate distribution of the remunerations.
The Minister has to approve the draft of the study.
The study provides:
- General data for Belgium
- Data per sector
- Data per category of protected works
- Budgetary data
If a research bureau asks you to collaborate on the five year study, you are obligated to do so.
Click here for the results of the first study. The second study has started on the 1st of December 2011 and will end in December 2012. The results will be published in the course of 2013.
